This website is operated by John Lightcap, (referred to as “Travel Safer LLC”, “we” or “us”). This Privacy Policy discloses the privacy practices for the Travel Safer LLC website located at www.travel-safer.com and the various related services (together referred to as this or our “Site”).  We are committed to protecting your privacy online.  The information provided below is designed to inform you of what information we collect, why we collect such information, and how we use the information we collect.  You acknowledge that this Privacy Policy is part of our Site, and by accessing or using our Site, you agree to be bound by all of its terms and conditions.

We will occasionally update this Privacy Policy.  When a revision is made we will revise the “last updated” date on this page.  We encourage you to check the date of our Privacy Policy each time you visit our Site for any updates or changes.  Your use of our Site constitutes your consent to this Privacy Policy, including any changes or updates.  We may make additional features, functionality, offers, activities, or events (“opportunities”) available to you subject to additional or different privacy rules that we disclose in connection with those opportunities.

This Privacy Policy is incorporated and subject to the terms and conditions set forth in our Terms of Service.  If you do not agree to the Terms of Service, please do not access or use our Site.

SECTION 1 – TYPES OF INFORMATION COLLECTED

In order to better provide you with our services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information. Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using our Site.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are.  When you engage in certain activities on our Site, such as ordering a product, submitting User Materials (as defined in the Terms of Service), and/or posting content in public areas, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form.  It is completely optional for you to engage in these activities.  If you elect to engage in these activities, however, we may ask that you provide us personal information, such as your first and last name, mailing address (including zip code), email address, employer, job title and department, telephone and facsimile numbers, and other personal identifying information. When ordering products or services on our Site, you may be asked to provide a credit card number. Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary.  If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the website’s Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP”) address. A URL is the global address of documents and other resources on the World Wide Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination. In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate on the Internet.

SECTION 2 – HOW DO WE COLLECT YOUR INFORMATION?

We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us.  You provide certain Personally Identifiable Information to us when you (a) register for our services and register your email address; (b) sign up for special offers from selected third parties; (c) send email messages, submit forms or transmit other information by telephone or letter; or (d) submit your credit card or other payment information when ordering and purchasing products and services on our Site.  We may also collect information from you at other points on our Site that state that such information is being collective.

In addition, we may also collect certain Non-Personally Identifiable Information.  This information is ultimately stored in the form of store categories, and, in some cases, specific URLs.  We use your IP address to diagnose problems with our servers, software, to administer our Site, and to gather demographic information.

SECTION 3 – WHAT DO WE USE YOUR PERSONAL INFORMATION FOR?

We will primarily use your Personally Identifiable Information to provide our services to you, as required by our agreements with you.  We will also use Personally Identifiable Information to enhance the operation of our Site, fill orders, improve our marketing and promotional efforts, statistically analyze website use, improve our product and service offerings, and customize our Site’s content, layout, and services.  We may use Personally Identifiable Information to deliver information to you and to contact you regarding administrative notices.  We may also use Personally Identifiable Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Service and this Private Policy.  With your permission, we may also use Personally Identifiable Information to send you emails about our Site, special promotions, new products and services, and other updates.

We may create anonymous records from Personally Identifiable Information by excluding information (such as your name) that makes the information personally identifiable to you.  We may use these records for internal purposes, such as analyzing usage patterns so that we may enhance our services, and we also reserve the right to use and disclose any information in such records at our discretion.

SECTION 4 – CONSENT

When you submit your Personally Identifiable Information to us, you are giving us your consent to the collection, use, and disclosure of your information as set forth in this Privacy Policy.

SECTION 5 – DISCLOSURE

We do not sell, trade, or rent your Personally Identifiable Information to others.  We do provide some of our services through contractual arrangements with trusted affiliates, services providers, and partners, and in certain circumstances we may share your Personally Identifiable Information with our trusted affiliates, service providers, and partners.

Service Providers:  We use trusted third-party service provides to perform certain services on our behalf, including payment processing, shipping, data storage/management, webhosting, etc.  These service providers only receive Personally Identifiable Information if such information is needed to perform their function, and they are not authorized to use any Personally Identifiable Information for any other purpose.  For example, we must release your credit card information to the card-issuing bank to confirm payment for products and services purchased on this Site; release your address information to the delivery service to deliver products that you ordered; and provide order information to third parties that help us provide customer service.

Certain service providers, such as payment gateways and other payment transaction processors, have their own policies with respect to the Personally Identifiable Information we are required to provide to them for your purchase-related transactions.  The use of your Personally Identifiable Information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us, so if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.  As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Special Events: If you choose to participate in a special event (for example, a promotion, contest, or sweepstakes), we may share your personal information with those organizations participating in the applicable event. Unless we tell you otherwise in connection with a special event, these third parties do not use your information for any other purpose other than to manage the event. We may authorize trusted partners to send you information about products and services that may be of interest to you.

Partners: We may provide information to carefully selected partners. In such cases, we might share and/or cross-reference information, including Personally Identifiable Information that will enable such persons or entities to contact you regarding products and services that may be of interest to you.

Compliance with Law and Fraud Protection: We may, and you authorize us to use and disclose any information, including personal information: (a) we deem necessary, in our sole discretion, to comply with any applicable law, regulation, legal process, or governmental request; (b) in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any personal or as otherwise required by law; (c) to other companies and organizations for credit fraud protection and risk reduction; and (d) to enforce any agreement we have with you.  We will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation.  We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

Business Transfer: Your Personal Identifiable Information may be disclosed as part of any merger, sale of company assets or acquisition, as well as in the event of an insolvency, bankruptcy or receivership, in which Personally Identifiable Information would be transferred as one of the business assets of Travel Safer LLC.

We may also provide Non-Personally Identifiable Information about our customers’ sales, traffic patterns, and related site information to third party advertisers, but these statistics do not include any Personally Identifiable Information.

SECTION 6 – UPDATING, CORRECTING, OR DELETING INFORMATION

We believe you should have the ability to access and edit the Personally Identifiable Information that you have provided to us.  You may change any of your Personally Identifiable Information in your account online at any time by linking to your account in accordance with instructions posted elsewhere on this Site.  You may also access and correct your personal information and privacy preferences by emailing us at [email protected] or mailing your request to:

Please include your name, address, and/or email address when you contact us.

We encourage you to promptly update your Personally Identifiable Information if it changes. You may ask to have the information on your account deleted or removed; however, because we keep track of past transactions, you cannot delete information associated with past transactions on this Site.  In addition, it may be impossible to completely delete your information without some residual information because of backups.

Section 7 – USER CHOICES ON COLLECTION AND USE OF INFORMATION

We may, from time to time, send you emails regarding our products and services. In addition, if you indicated at any time that you are interested in receiving offers or information from us and our partners, we may occasionally send you direct mail about products and services that we feel may be of interest to you.  Only Travel Safer (or agents working on behalf of Travel Safer and under confidentiality agreements) will send you these direct mailings and only if you indicated that you do not object to these offers.  If you do not want to receive such mailings, simply tell us when you give us your personal information.  Or, at any time you can easily edit your account information to no longer receive such offers and mailings.

You also have choices with respect to cookies, as described below.  By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Site may not work properly in your case.

Section 8 – security

To protect your personal information, we take reasonable precautions and follow industry practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.  While we strive to safeguard your Personally Identifiable Information once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secured and, accordingly, we cannot guarantee or warrant the security of any information you disclose or transmit to us.

Payments:  If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all of the Payment Card Industry Data Security Standard (PCI-DSS) requirements and implement additional generally accepted industry standards.

If you choose a direct payment gateway to complete your purchase, then the Merchant Processor will store your credit card information. It is encrypted through PCI-DSS. Your transaction information is stored only as long as is necessary to complete your transaction.  After your transaction is complete, your transaction information is deleted.  All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 9 – COOKIES

When you use our Site we will store cookies on your computer in order to facilitate and customize your use of our Site. A cookie is a small data text file, which a Web site stores on your computer’s hard drive (if your Web browser permits) that can later be retrieved to identify you to us.  Our cookies store randomly assigned user identification numbers, the country where you are located, and your first name to welcome you back to our Site. The cookies make your use of the site easier, make the site run more smoothly and help us to maintain a secure site.  You are always free to decline our cookies if your browser permits, but some parts of our Site may not work properly in that case.

SECTION 10 – THIRD-PARTY SITES

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you.  Other sites accessible through our Site have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy.  We are not responsible for the policies or practices of third parties.

SECTION 11 – Links

Our Site may provide links to other third-party Web sites that are outside our control and not covered by this Privacy Policy.  We are not responsible for the privacy practices of other Web sites and encourage you to review the privacy policies posted on these (and all) Web sites.

SECTION 12 – AGE OF CONSENT

By accessing and using this Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given your consent to allow your minor dependents to use this Site.
